# Stop China's IP Theft Act: What It Actually Does

This bill would ban certain Chinese government officials and military members from entering the United States as a way to pressure China to stop stealing American intellectual property. The bill targets high-ranking members of the Chinese Communist Party, including top political leaders and their families, as well as active-duty members of China's military. The idea behind it is that by restricting travel for these officials, the U.S. government can leverage pressure on China's leadership to stop what lawmakers describe as widespread theft of American technology, patents, trade secrets, and other intellectual property.

The bill would give the Secretary of State and Department of Homeland Security the power to deny visas and entry to these specific groups of people. The restrictions would apply to senior Communist Party officials like those in the Politburo and Central Committee, members of China's cabinet, active-duty military officers, and the spouses and children of top party leaders. This is a pretty broad travel ban affecting thousands of people in China's government and military hierarchy.

However, there's an escape clause built into the bill. If the Director of National Intelligence certifies each year that China has stopped its intellectual property theft efforts, the travel ban would be lifted. In other words, the restrictions aren't permanent—they're meant as leverage to encourage China to change its behavior. If China stops the alleged theft activities, the ban goes away. The bill essentially uses travel access as a bargaining chip in what the U.S. sees as an ongoing problem of Chinese entities stealing American technology and business secrets.

Stop China's IP Theft Act This bill directs the Department of State and the Department of Homeland Security to deny entry into the United States to senior Chinese Communist Party officials, the spouses and children of such officials, members of the cabinet of the Chinese government, and active duty members of China's armed forces. This prohibition shall not apply in any year in which the Office of the Director of National Intelligence certifies to Congress that China's government has stopped sponsoring, funding, facilitating, and actively working to support efforts to infringe the intellectual property rights of U.S. citizens and companies.
