# Understanding the Fight Notario Fraud Act of 2024

This bill creates new federal crimes to punish people who scam immigrants by pretending to be lawyers or immigration experts when they're not. The term "notario" refers to people in some countries who are legitimate legal professionals, but in the U.S., scammers often use this title to trick immigrants into thinking they have legal credentials they don't actually have. These fraudsters take money from vulnerable people for immigration services they either never provide or provide incompetently, sometimes causing serious damage to someone's immigration case or status.

The bill makes it illegal to run any kind of scheme to defraud someone in connection with immigration matters, whether that's taking money under false pretenses or making fake promises about what you can do. It specifically targets people who falsely claim to be lawyers or accredited immigration representatives. The penalties start at up to one year in prison and fines, but increase to up to three years if the total money stolen from all victims exceeds $10,000 or if the fraud causes someone to lose their immigration status or get deported. The bill also makes it a crime to threaten to report someone to immigration authorities or to sabotage their immigration case as a way to force them to pay money or comply with demands.

To enforce these new laws, the bill requires the Attorney General to set up at least 15 specialized prosecutors in areas hit hardest by this fraud, with preference given to prosecutors who speak languages commonly used by immigrant communities. The government must also create ways for people to report fraud, publish information in multiple languages about how to spot and prevent these scams, and report annually to Congress on how many cases are being prosecuted. Any money recovered from these criminals that can't be returned to victims goes into a fund to help crime victims. Essentially, this bill aims to protect immigrants from being exploited by con artists who prey on their unfamiliarity with the U.S. legal system.
