# Understanding the Protecting Foster Youth Resources Act

This bill is designed to stop states from taking money that belongs to foster children and using it to pay for the foster care system itself. Right now, when foster kids receive Social Security benefits or other money—whether from a deceased parent's benefits, disability payments, or other sources—states can legally take that money and use it to cover the costs of caring for the child. This bill would change that by requiring states to keep those benefits separate and use them for the child's own needs instead.

The bill creates several new protections for foster youth. First, it requires states to screen every foster child to see if they qualify for Social Security or disability benefits they might not know about, and then help them apply for those benefits. Second, it mandates that states develop a personalized plan for each foster child that explains how their money will be managed and saved for their future. This plan must consider what the child will need after they leave foster care—things like education, housing, and employment. States would be required to put money the child doesn't immediately need into special savings accounts that won't count against benefit limits, such as ABLE accounts or individual development accounts designed specifically for this purpose.

The bill also ensures that foster children, their lawyers, and guardians are notified whenever the state is appointed to manage their benefits, giving them a chance to object or request changes. Additionally, states must provide foster youth with an annual accounting of any assets or money they used on the child's behalf, so young people know exactly what happened to their resources. To help states implement these changes, the bill provides $4.5 million in funding for technical assistance and requires the federal government to reimburse states for 75 percent of the costs of managing these new benefit eligibility and asset management requirements.
