# Understanding the DEVICE Act of 2023

This bill creates new rules for medical device manufacturers to keep the public informed about important changes to their products and to ensure devices are properly cleaned before reuse. Think of it as requiring manufacturers to be more transparent about what they're doing with medical equipment.

The bill has three main parts. First, manufacturers must notify the FDA before making any changes to how a device is designed or how it should be cleaned and reprocessed between uses. This is important because a small change in design or cleaning instructions could affect whether a device works safely. Second, if a manufacturer tells doctors in other countries about a design change, a safety problem, or new cleaning procedures, they must also tell the FDA within five days. The idea here is that if something is important enough to warn foreign hospitals about, American hospitals should know about it too. Third, the bill creates a new category of medical devices called "rapid assessment tests" that are specifically designed to check whether reusable medical equipment has been properly cleaned. These might be test strips or other tools that verify sterilization worked correctly.

For patients and hospitals, this means better oversight of medical devices and more assurance that equipment is being properly maintained. Manufacturers will need to be more careful about documenting changes and keeping regulators in the loop. The bill essentially closes a gap where companies could make changes or communicate safety issues to international partners without telling American regulators, potentially leaving U.S. patients with outdated or incomplete information about the devices being used on them.

DEVICE Act of 2023

Disclosure; and Encouragement of Verification, Innovation, Cleaning, and Efficiency Act of 2023 or the DEVICE Act of 2023 This bill addresses design changes and reprocessing of medical devices. (Reprocessing of medical devices is the process for cleaning and sterilizing or disinfecting devices for reuse.) Specifically, medical device manufacturers must notify the Food and Drug Administration (1) before making changes to the design or reprocessing instructions of a device, and (2) no more than five days after widely disseminating to health care providers in a foreign country communications regarding changes to the design or reprocessing instructions of a device or regarding a safety concern about a device. A device may not be sold if the manufacturer violates these notification requirements.
