# Understanding the SOS ACT Act

This bill creates a government program to help protect American companies from being bought out by Chinese interests, particularly during times of economic crisis. Here's what it actually does: The Treasury Department would be authorized to guarantee up to 50 percent of investment losses for people who put money into certain American businesses that are struggling financially and at risk of being purchased by Chinese entities or investors. Think of it like the government saying, "If you invest in this vulnerable American company and it fails, we'll cover half your losses"—but only for companies that matter to national security.

The bill specifically targets companies that have been hurt by COVID-19 and are considered important to America's defense and security interests. The government would use $10 billion from existing pandemic relief funds to back these investment guarantees. Before the program could start, the Treasury Secretary, Defense Secretary, and Commerce Secretary would need to work together to figure out which types of companies qualify and which ones should get priority based on military and strategic needs. They'd have to report their criteria to Congress within 15 days of the bill passing.

There are important limits built in. Investors can only receive compensation for up to three years after the emergency period ends, and only if the company's failure is directly related to COVID-19 problems. The program itself would only run for one year from when the criteria are announced. Essentially, this is a temporary safety net designed to keep strategically important American businesses from falling into Chinese hands during the pandemic-driven economic downturn by making it financially safer for investors to prop them up.

Secure Our Systems Against China's Tactics Act or the SOS ACT Act This bill authorizes the Department of the Treasury to temporarily guarantee up to 50% of an investment made during the public health emergency declared due to COVID-19 (i.e., coronavirus disease 2019) in a business that (1) incurred losses due to COVID-19, (2) advances a national security interest, and (3) is susceptible to being purchased by a Chinese entity.
