# China Technology Transfer Control Act of 2021

This bill is designed to stop American companies and foreign businesses from sending advanced technology and intellectual property to China. The government is concerned that China systematically acquires American innovations—both through legitimate business deals and through espionage—and uses them to strengthen its military and support government-backed industries, while also using some technologies to monitor and control its own population.

The bill creates a system where the President must control exports of certain sensitive technologies to China, including things like artificial intelligence, semiconductors, robotics, biotechnology, and advanced computing systems. It also covers intellectual property like patents, copyrights, and trade secrets. The government has 180 days after the bill passes to write the specific rules about what can and cannot be exported. If you work for a company that develops cutting-edge technology, your employer would need government permission before sharing that technology with Chinese companies or individuals.

The bill also imposes serious financial penalties on anyone who violates these rules. Foreign companies and Chinese entities that knowingly buy or sell restricted technology face having all their property and assets in the United States frozen and blocked. This means their bank accounts, investments, and business operations in America would be shut down. The only exception is that the government can't block the importation of physical goods—just the technology and information itself. The President can waive these penalties if he decides it's in America's national security interest to do so.

Additionally, the bill requires the government to create and update a list each year of Chinese products that receive government support under China's "Made in China 2025" industrial plan, as well as products that use technology for human rights violations. This list helps identify which industries and products are priorities for the Chinese government, making it easier to spot what technology shouldn't be shared.

China Technology Transfer Control Act of 2021 This bill controls exports of certain national interest technology and intellectual property to China. Specifically, covered technology or intellectual property includes items that (1) would contribute significantly to the Chinese military to the detriment of U.S. national security, (2) are included in a designated list of product components compiled by the U.S. Trade Representative (USTR), or (3) are used by China to violate human rights or religious liberties. The President must control exports to China of any covered technology or intellectual property. Further, the President must sanction (1) a foreign person who sells to China or purchases from China any covered item, and (2) a Chinese person who knowingly uses a covered item provided to them in violation of U.S. export control law. In addition to a specified list of industries subject to the bill, the USTR must identify certain products from China that either receive designated support from the Chinese government or are used by China to violate human rights or religious liberties.
