# Understanding the SHIELD Act of 2025

The SHIELD Act makes it a federal crime to share intimate photos or videos of someone without their permission, particularly when it causes them harm. This law targets what's commonly known as "revenge porn"—the malicious distribution of private sexual images. If you take a nude photo with someone's consent, that consent only covers that specific photo being created; it doesn't automatically mean they've agreed to let you share it with others. The law recognizes this important distinction and makes sharing such images illegal under federal law.

The bill creates two main categories of crimes. For adults, it's illegal to distribute intimate images if the person depicted had a reasonable expectation of privacy, the image wasn't voluntarily shared in public, and the distribution either intends to cause harm or actually does cause psychological, financial, or reputational damage. For minors, the law is stricter—sharing nude images of anyone under 18 is illegal if it's meant to abuse, humiliate, harass, or gratify sexual desire. Violations can result in up to two years in prison for adult intimate images and up to three years for images of minors, plus fines and forfeiture of any devices or money used in the crime.

The law includes important exceptions so it doesn't punish people for legitimate reasons. Law enforcement can still investigate crimes, people can report abuse to authorities or seek help, and the law allows for sharing images in legal proceedings, medical contexts, or educational purposes. Internet service providers and social media platforms aren't held responsible for content users post unless the platform intentionally promotes this type of harmful material. The law also applies to threats to share such images, making it illegal to use the threat of exposure as a tool for extortion or intimidation.

Stopping Harmful Image Exploitation and Limiting Distribution Act of 2025 or the SHIELD Act of 2025This bill establishes new federal criminal offenses related to the distribution of sexual exploitative content.&nbsp;First, the bill makes it a crime to knowingly mail or distribute (or intentionally threaten to mail or distribute) an intimate visual depiction of a&nbsp;recognizable adult engaged in sexual conduct.&nbsp;To constitute a crime, certain elements must be met, including that the distribution must be nonconsensual; the depiction is not a matter of public concern; and the distribution must be intended to cause harm or cause harm.&nbsp;A violator is subject to a fine, a prison term of up to two years, or both; mandatory restitution; and the forfeiture of material involved in the offense, property constituting or derived from the proceeds from the offense, and property used to commit or facilitate the offense.Second, the bill makes it a crime&nbsp;to knowingly mail or distribute (or intentionally threaten to mail or distribute) a visual depiction of a nude minor with intent to abuse, humiliate, harass, or degrade the minor, or to arouse or gratify the sexual desire of any person. A violator is subject to a fine, a prison term of up to three years, or both; mandatory restitution; and the forfeiture of material involved in the offense, property constituting or derived from the proceeds from the offense, and property used to commit or facilitate the offense.
