This bill is designed to protect federal workers and government contractors from losing their homes, having their wages garnished, or facing other serious financial consequences during government shutdowns or when the country hits its debt limit. Here's the core problem the bill addresses: When Congress fails to pass a budget and the government shuts down, federal workers often get furloughed (sent home without pay) or forced to work without receiving paychecks. Meanwhile, their bills don't stop—landlords still expect rent, mortgage companies still want payments, and student loan servicers still demand monthly installments. This bill says that during a shutdown and for 30 days after it ends, federal workers get legal protection from eviction, foreclosure, and other collection actions if they can show the shutdown made it impossible to pay.

The specific protections are substantial. Landlords cannot evict a federal worker from their home during a shutdown without going to court first. Banks cannot foreclose on mortgages or seize property without a court order. Student loan companies cannot place loans in default, send them to collections, report them to credit agencies, or garnish wages without court approval. Insurance policies—health, life, disability, and car insurance—cannot be cancelled just because someone missed a premium payment during the shutdown. Federal income taxes can be deferred for up to 90 days after the shutdown ends, and no interest or penalties accrue during that waiting period.

The bill also prevents creditors from punishing workers for using these protections. A bank cannot deny someone a loan, raise interest rates, or change credit terms simply because that person asked for a court stay on their mortgage during a shutdown. Credit reporting agencies cannot mark someone's credit as damaged for missing payments they were legally protected from making. Additionally, courts have the power to reduce or even waive fines and penalties if someone failed to meet a contract obligation specifically because of the shutdown's financial impact.

The law applies to all federal workers—employees of executive agencies, Congress, the courts, and contractors who work for the government. It covers both situations where Congress fails to pass a budget and situations where the country exceeds its debt limit. Employers are required to notify workers about these protections when they're hired and again whenever a shutdown begins. Violating these protections is a misdemeanor punishable by fines or up to a year in prison. Federal Employees Civil Relief Act This bill establishes a framework to temporarily suspend certain judicial and administrative proceedings against a federal employee or contractor during a shutdown. Under the bill, a shutdown is a period in which (1) there is more than a 24-hour lapse in appropriations for any federal agency or department because a regular appropriations bill or a continuing resolution has not been enacted, or (2) the debt of the federal government is greater than the statutory limit. A federal worker (i.e., an employee of a government agency or contractor) who is furloughed or required to work without pay during a shutdown may apply to a court for a temporary stay, postponement, or suspension with respect to any payment of rent, mortgage, tax, fine, penalty, insurance premium, student loan repayment, or other civil obligation or liability that the worker owes or would owe during the duration of the shutdown. The bill includes related provisions that restrict evictions, foreclosures, the enforcement of liens, and the termination of insurance policies during a shutdown. It also provides for the deferral of federal income taxes and student loan payments during a shutdown. The Department of Justice may commence a civil action against any person who engages in (1) a pattern or practice of violating the requirements of this bill, or (2) a violation that raises an issue of significant public importance. A person aggrieved by a violation of this bill's requirements may also bring a private right of action.
