# Law Enforcement Protection and Privacy Act of 2025

This bill is designed to protect gun dealers and manufacturers from having their sensitive business records publicly disclosed. At its core, it creates new legal penalties and allows gun dealers to sue if their information gets leaked without authorization.

Here's what's actually happening: The federal government maintains a database called the Firearms Trace System that tracks guns used in crimes. Gun dealers are required to keep detailed records of their sales and report certain information to federal authorities. The bill makes this information much harder to access through Freedom of Information Act requests—basically the main tool citizens and journalists use to get government documents. It adds a new exemption saying that firearm trace data and gun dealer records cannot be released to the public, even if someone formally requests them.

The bill also creates financial consequences for anyone who leaks this information. If a state, local, or tribal government agency illegally discloses gun dealer records, the federal government can fine them $10,000 for a first offense or $25,000 for repeat violations. They could also lose access to the federal database for a year. More significantly, gun dealers themselves can now sue any government agency or entity that improperly releases their information and potentially recover triple their actual damages (or at least $25,000 per piece of leaked information), plus punitive damages and attorney fees.

The practical effect is that gun dealer records become significantly more protected from public scrutiny, and there are now real financial incentives—both penalties and lawsuit liability—to keep this information confidential. This could make it harder for researchers, journalists, and advocacy groups to access information about gun sales patterns or trace guns used in crimes, while simultaneously making it easier for gun dealers to pursue legal action if their records are disclosed.
