# Stop Tax Penalties on American Hostages Act of 2025

This bill gives tax relief to Americans who have been held hostage or wrongfully detained abroad by the U.S. government or foreign powers. Essentially, it says that if you're kidnapped or illegally imprisoned overseas, the IRS won't penalize you for missing tax deadlines while you're being held captive.

Here's how it works in practice: Imagine an American citizen is taken hostage in another country for two years. During that time, they can't file their tax return or pay taxes because they're imprisoned. Normally, the IRS would charge them penalties and interest for filing late and paying late. This bill stops that from happening. The time you spend in captivity doesn't count against you—it's essentially frozen for tax purposes. If you were supposed to file on April 15 but were held hostage until June, the IRS treats it as if you filed on time. The same goes for any penalties, interest, or fees that piled up during your detention.

The bill also creates a refund program for people who already paid these penalties before being officially recognized as hostages or wrongfully detained individuals. If you paid late fees or penalties while imprisoned and later got released and officially identified as a hostage, you can apply to get that money back. The government has until January 1, 2026 to set up this program, and the State Department and Justice Department will maintain lists of who qualifies. People have one year from when they're notified about the program to apply for their refunds. The bill applies to anyone held hostage or wrongfully detained starting January 1, 2021, and covers their spouses and dependents as well.
