The bill says these retirees should get the complete pension benefits they earned and vested for (meaning they had a guaranteed right to receive), rather than the reduced amounts they currently get.

Here's what actually happens: When these pension plans were terminated, the Pension Benefit Guaranty Corporation (PBGC)—a federal agency that protects pensions—took over and paid out benefits, but they were limited by federal caps and phase-in rules. This meant retirees got less than what they had actually earned. The bill removes those limits for six specific Delphi-related pension plans and says retirees should receive their full vested benefits going forward. More importantly, the bill requires the PBGC to recalculate what people should have been paid all along and send them a lump-sum payment for all the money they were underpaid, plus interest calculated at six percent per year.

The payment process has a specific timeline: within 180 days of the bill becoming law, eligible retirees will receive their back-pay lump sum. After that, their monthly pension checks will increase to reflect the full benefit amount they should have been getting. For tax purposes, the lump-sum payment gets spread out over three years for income tax calculations, which reduces the tax hit in any single year. The bill covers current retirees receiving payments and those eligible for future payments, though it excludes people who already received special top-up benefits from General Motors. The funding comes from existing PBGC reserves, so it doesn't require new taxpayer money.
