# Citizenship for Essential Workers Act: What It Means

This bill would create a new pathway for certain workers to become permanent residents (green card holders) and eventually citizens. Specifically, it targets people who worked in jobs considered essential during the COVID-19 pandemic—jobs like healthcare, food service, agriculture, construction, sanitation, and many others. The bill recognizes that these workers kept the country running during the crisis and offers them a way to legalize their immigration status.

To qualify, you'd need to have worked in one of the designated essential sectors at any point since January 1, 2021, and you'd need to be physically present in the United States when you apply. The bill also covers family members of eligible workers—their spouses, parents, children, and siblings could potentially get status too. Additionally, it includes people who had to stop working in essential jobs because conditions were too dangerous, surviving family members of workers who died from COVID-19, and relatives of military members.

The bill does have some restrictions. You can't qualify if you've been convicted of a felony or multiple misdemeanors, though the government has some flexibility to waive certain minor offenses depending on your circumstances. You also can't qualify if you were already a permanent resident, refugee, or asylee on January 1, 2021, or if you were in authorized visa status at that time (with some exceptions). You'd need to pass background checks and pay a processing fee, though the bill allows for fee waivers for people who can't afford them.

Essentially, this bill is designed to provide legal status and a path to citizenship for undocumented immigrants who performed critical work during the pandemic, along with their family members. It acknowledges their contributions while still maintaining security screening requirements.

Citizenship for Essential Workers Act This bill establishes a mechanism for eligible aliens who worked as essential workers during the declared COVID-19 (i.e., coronavirus disease 2019) public health emergency to apply for and obtain permanent resident status. The bill also narrows certain grounds for deportability and inadmissibility. To be eligible for permanent resident status under this bill, an alien must have earned income at any point during the COVID-19 emergency period doing work deemed essential by the Department of Homeland Security (DHS) or a state or local government. An alien may also be eligible if that alien is a parent, spouse, or child of (1) an eligible alien who died from COVID-19, or (2) a member of the Armed Forces. Certain aliens shall be ineligible, such as an alien who was a refugee on January 1, 2021. To obtain permanent resident status under this bill, an applying alien must satisfy additional requirements, including by passing a background check. Furthermore, the bill repeals provisions providing for three-year bars and permanent bars to admission into the United States. (Generally, these bars apply to aliens who were previously removed or unlawfully present in the United States.) The bill also narrows the scope of certain crime-based grounds for inadmissibility or deportability, such as by redefining the term conviction to exclude expunged convictions. The Department of Justice or DHS may waive certain grounds of inadmissibility or deportability (1) for humanitarian purposes, (2) to ensure family unity, or (3) for the public interest.
