The bill is named after Asunción Valdivia, a farmworker who died of heat stroke in 2004 after working ten hours picking grapes in 105-degree heat. Instead of calling an ambulance, his employer told his son to drive him home, and he died on the way. The bill's supporters point out that heat kills more Americans annually than hurricanes, floods, and tornadoes combined, yet we have no federal rules requiring employers to protect workers from it. The bill emphasizes that heat-related jobs are disproportionately held by Black and Latino workers, making this a racial justice issue as well as a safety one.

If passed, employers would be required to develop written heat prevention plans that include providing workers with water, paid rest breaks in shaded or air-conditioned areas, training on heat illness warning signs, and emergency response procedures. Employers would also need to monitor temperatures, create acclimatization schedules for new workers, and compensate piece-rate workers (those paid per item produced) for mandatory rest breaks. The rules would apply to both outdoor workers like farmworkers and construction workers, and indoor workers in places like warehouses, kitchens, and factories without adequate cooling. Importantly, the bill includes protections against retaliation—employers cannot punish workers for reporting heat-related problems or seeking medical help.

The bill gives OSHA two years to propose a standard and 42 months total to finalize it. If OSHA misses the deadline, an interim standard would automatically take effect, ensuring some protection doesn't get delayed indefinitely. This means employers in heat-intensive industries should expect significant new compliance requirements and costs within the next few years, while workers in these industries would gain concrete legal protections and the right to safe working conditions in extreme heat.

Asuncion Valdivia Heat Illness and Fatality Prevention Act of 2021 This bill requires the Department of Labor to promulgate an occupational safety or health standard on prevention of exposure to excessive heat. Excessive heat includes outdoor or indoor exposure to heat at levels that exceed the capacities of the body to maintain normal body functions and may cause heat-related injury, illness, or fatality. In addition, the bill establishes requirements concerning (1) training and education to prevent and respond to heat illness, and (2) whistle-blower protections.
