# Understanding the COBALT Supply Chain Act

This bill targets a specific problem: cobalt that's mined in the Democratic Republic of Congo (DRC) using child labor and forced labor, then refined in China, and ends up in products Americans buy. The bill aims to keep these products out of the U.S. market by making it much harder for companies to import goods containing Chinese-refined cobalt without proving the cobalt wasn't produced through exploitation.

Here's why this matters. Cobalt is essential for lithium-ion batteries in electric vehicles, smartphones, laptops, and other electronics. The DRC has over half the world's cobalt reserves and supplied about 70 percent of global cobalt production in 2021. The problem is that Chinese companies now control most of the DRC's cobalt mining—they own or finance 15 of the country's 19 cobalt mines. According to the bill, between 40,000 and 255,000 children work in artisanal and small-scale cobalt mining in the DRC, often in dangerous conditions. Much of this cobalt gets exported to China for processing, then shipped back out to the world market, including to America.

The bill creates a legal presumption that any product containing cobalt refined in China is made with forced or child labor—unless the importer can prove otherwise with "clear and convincing evidence." This flips the burden of proof: instead of the government having to prove a product was made with exploited labor, companies have to prove it wasn't. Customs officials will block these goods at the border starting 180 days after the bill passes. The bill also requires the government to create an enforcement strategy, maintain lists of Chinese companies involved in DRC cobalt mining, and ensure that products denied entry don't sneak in through other countries like Canada or Mexico. Additionally, the federal government must certify annually that vehicles it purchases don't contain parts made with child or forced labor from the DRC or China's Xinjiang region.

For consumers, this could mean higher prices for electric vehicles and electronics as companies scramble to find alternative cobalt sources or invest in proving their supply chains are clean. For companies importing these products, compliance will become significantly more expensive and complicated. The bill essentially uses America's market power to pressure the cobalt industry to clean up labor practices in the DRC.
