# Plain Language Summary: Survivor Justice Tax Prevention Act

Right now, when someone wins a lawsuit or settles a case for sexual abuse or assault, they might have to pay federal income taxes on that money. This bill changes that by saying survivors of sexual abuse don't have to pay taxes on the compensation they receive—with one important exception. If the money is specifically labeled as "punitive damages" (extra money meant to punish the wrongdoer rather than compensate the victim), that portion would still be taxable. Everything else—the money meant to cover medical bills, therapy, lost wages, pain and suffering, and other harms—would be tax-free.

The bill also makes it easier for survivors to claim this tax break. Currently, the IRS might demand medical records or other proof that sexual abuse actually occurred before allowing someone to exclude the money from their taxes. This bill says the IRS can't reject a claim just because there are no medical records. If a court judgment or settlement agreement states the money is for sexual abuse or assault, that's enough. This matters because many survivors never seek medical treatment, report to police, or have documentation of what happened to them, yet they still deserve the tax relief.

The changes would apply to any settlements or court judgments finalized after this bill becomes law, though if someone updates an old settlement agreement, it wouldn't count as a new agreement. The Treasury Department would also be required to spread the word about this tax break so survivors actually know it exists and can take advantage of it. Essentially, this bill recognizes that money awarded to survivors of sexual abuse is meant to help them heal and rebuild their lives—not to be treated as income the government should tax.
