# Understanding the Chisholm and Western National Historic Trail Designation Act

This bill officially recognizes two historic cattle trails that played a major role in American history during the late 1800s. The Chisholm Trail ran about 1,378 miles from South Texas through Oklahoma to Kansas between 1867 and 1884, while the Western Trail stretched roughly 1,350 miles from Texas through Oklahoma and Kansas to Nebraska between 1874 and 1897. Both routes were heavily used by ranchers and cattle drovers to move their herds to market. By designating these as official National Historic Trails, the government is essentially saying these routes are important enough to preserve and protect as part of America's heritage.

The federal government, through the Department of the Interior, will manage these trails as a single unit and can accept donations of land along the routes. However, the bill includes strong protections for private property owners. The government cannot force anyone to sell their land or use eminent domain to acquire property for the trails. If someone owns land along the trail route, they can choose whether to participate—the government can only manage portions of the trail on private land if the owner voluntarily agrees. Owners can also end their participation at any time through a certification agreement.

The bill specifically protects economic activities in the region. It states that designating these trails won't interfere with oil, gas, or other energy development, won't create protected buffer zones around the trails, and won't require new federal permits for activities on nearby land. Essentially, if you're a rancher, energy company, or business owner near these historic routes, the trail designation shouldn't restrict what you can do on your property or nearby areas. The government will cover the costs of mapping the trails and managing them, but private landowners won't be forced into participation or burdened with new regulations.

Chisholm National Historic Trail and Western National Historic Trail Designation Act This bill designates (1) the Chisholm National Historic Trail, and (2) the Western National Historic Trail. The Department of the Interior shall administer any portion of these trails that is located on nonfederal land only (1) with the voluntary consent of the owner of the nonfederal land, and (2) if the portion qualifies for certification as a component of the applicable trail. The approval by an owner of applicable nonfederal land of a certification agreement shall satisfy the voluntary consent requirement. A certification agreement may be terminated at any time. The establishment of these trails does not authorize any person to enter private property without the consent of the private property's owner. Interior may accept a donation of land or an interest in land for these trails, with specified exceptions. Land or an interest in land may not be acquired for these trails by eminent domain or condemnation.
