# Understanding the Community First Act

The Community First Act creates a new federal grant program designed to help local communities reduce the number of people sitting in jail waiting for trial. Right now, many people accused of crimes spend weeks or months in local jails simply because they can't afford bail, even though they haven't been convicted of anything. This bill provides federal funding to help communities tackle that problem through a combination of strategies tailored to their specific needs.

The program works in two phases. First, communities can apply for planning grants of up to $100,000 to study their local jail situation—figuring out who's being held, why they're being held, and whether certain groups are being treated unfairly. Then, communities can apply for larger implementation grants (ranging from $500,000 to $3 million per year for six years) to actually put solutions into practice. These solutions could include reducing reliance on cash bail, creating programs that divert people away from jail entirely, getting lawyers involved earlier in the process, speeding up court cases, or establishing mental health and substance abuse services as alternatives to incarceration.

To qualify for funding, communities must form partnerships involving at least two of these groups: local government, nonprofits, tribal governments, or territories. The bill requires grantees to work with law enforcement, courts, public defenders, community members (including formerly incarcerated people), and local organizations throughout the entire process. Importantly, communities that receive implementation grants must achieve specific results—reducing jail populations by at least 5 percent in the first year, 10 percent annually after that, and 50 percent by the end of the grant period. If they fail to meet these targets, the federal government will audit their program and potentially pull funding. The bill also requires communities to track whether their efforts are reducing incarceration fairly across all racial and ethnic groups, addressing concerns that some communities are incarcerated at disproportionately higher rates.

The bill prioritizes funding for communities with the highest jail populations and gives preference to smaller cities and rural areas, ensuring that resources aren't concentrated only in large metropolitan areas. The federal government would invest $20 million annually in planning grants and $100 million annually in implementation grants from 2026 through 2030, with 10 percent of implementation funding reserved specifically for evaluating whether these programs actually work.
