The bill also allows marijuana to be transported across state lines as long as both the origin and destination states permit it. However, this doesn't mean a free-for-all—states can still set their own rules about where and how marijuana is sold, and they can keep it away from schools and minors. The bill maintains strict penalties for anyone who breaks state or tribal marijuana laws, sells to people under 18, or uses marijuana sales as a cover for trafficking other illegal drugs.

The federal government's role shifts from prohibition to regulation and oversight. The FDA will regulate marijuana products similar to how it handles alcohol-infused foods and cosmetics. The bill also establishes a federal excise tax on marijuana to fund administration, testing, enforcement, and youth prevention programs.
