# Understanding the Drone Act of 2023

This bill creates new federal crimes specifically targeting dangerous and illegal uses of drones. Right now, drone misuse falls under scattered laws that don't adequately address the specific problems drones create. This bill fills those gaps by establishing clear, serious penalties for the worst drone-related offenses.

The bill tackles five main categories of drone crimes. First, it makes it illegal to weaponize drones—meaning you can't attach firearms, explosives, or other weapons to them, and you can't use a drone to hurt people or damage property worth more than $5,000. Second, it prohibits using drones to commit felonies, particularly targeting smuggling operations at the border and drug trafficking. Third, it makes it a crime to tamper with a drone's identification number or disable its safety lighting and tracking systems, which helps law enforcement identify who's operating drones illegally. Fourth, it criminalizes flying drones in restricted airspace or across U.S. borders without permission—addressing the hundreds of drone sightings near airports that create collision hazards. Fifth, it specifically targets using drones to smuggle contraband into prisons or transport illegal goods.

The penalties are serious and scale with the severity of the offense. Tampering with identification, illegal airspace violations, and contraband smuggling can result in up to five years in prison. Weaponizing drones carries up to ten years. If someone uses a weaponized drone to cause serious injury or death, they face up to twenty years, and if death results, they could face life imprisonment or death penalty. The bill also makes it illegal to threaten, attempt, or conspire to commit these crimes—so planning to weaponize a drone is itself a federal offense.

The law includes reasonable exceptions for government agencies, law enforcement, and licensed activities like avalanche mitigation where controlled explosives from drones serve legitimate safety purposes. It also allows consensual drone competitions where people intentionally crash drones together. These exceptions ensure the law targets criminal activity without interfering with legitimate drone uses.

Drone Act of 2023 This bill creates a federal statutory framework to criminalize various conduct involving the misuse of drones. Among its provisions, the bill generally prohibits the <ul type="disc"> <li>operation of a drone that poses an imminent safety hazard to vessels or motor vehicles; </li> <li>weaponization of a drone (e.g., attaching a firearm or explosive); and </li> <li>operation of a drone that interferes with a law enforcement, emergency response, or military operation or activity of the federal government or of a state, local, or tribal government. </li> </ul>
