If they do this, they have to document why the financial factors weren't enough to choose between options. However, if you're in a 401(k)-style plan where you pick your own investments, plan managers can still offer socially conscious investment options—they just can't make them the automatic default choice.

**The bill also addresses how plan managers hire advisors and service providers.** It adds a requirement that when plans select people to help manage the money—like investment advisors or consultants—they must do so based purely on qualifications and cost, without considering race, color, religion, sex, or national origin. This is essentially extending existing civil rights protections to retirement plan hiring.

**For people who own company stock through their retirement plan, the bill changes proxy voting rules.** When you own shares, you technically have voting rights on company decisions. The bill clarifies that plan managers must vote these shares based only on what's financially best for your retirement, not on social or political goals. It also gives plan managers some flexibility—they can adopt policies saying they won't vote on every single issue, especially if the plan owns a small percentage of the company. They just need to document their voting decisions and monitor anyone they hire to help with voting.

**Finally, the bill requires clearer warnings about brokerage windows.** Many retirement plans let you invest in things beyond the standard options through a "brokerage window." Before you make any trade through this window, the plan must show you a four-part warning explaining that these investments aren't professionally selected like the standard options, might have higher fees and worse returns, and include a graph showing how different investment returns could affect your retirement balance. This takes effect in 2027, giving plans time to prepare.

Protecting Prudent Investment of Retirement Savings ActThis bill modifies the requirements for fiduciaries of employer-sponsored retirement plans.First, the bill generally requires a plan fiduciary to make investment decisions based solely&nbsp;on pecuniary factors (i.e., factors that a fiduciary prudently determines are expected to have a material effect on the risk or return of an investment based on appropriate investment horizons consistent with the plan's policies and objectives).The bill allows nonpecuniary factors to be considered in certain situations, such as when selecting investment options for certain participant-directed retirement plans or if the fiduciary is unable to distinguish between investment alternatives on the basis of pecuniary factors alone.The bill also prohibits a plan fiduciary from discriminating when selecting, monitoring, and retaining any fiduciary, counsel, employee, or service provider of the plan.The bill requires a plan fiduciary to act solely and prudently in accordance with the interests of the plan's&nbsp;participants and beneficiaries when exercising a shareholder right (e.g., voting of proxies). However, the fiduciary duty to manage shareholder rights does not require the voting of every proxy or the exercise of every shareholder right.Finally, the bill requires a plan fiduciary to provide specified notices with respect to a pension plan that provides a participant or beneficiary the opportunity to select from designated investment alternatives.
