The problem, according to this bill, is that criminals can intercept this e-waste and use it to create counterfeit electronics—fake versions of real products that look legitimate but aren't. These counterfeits can then sneak back into American supply chains and end up in military equipment, hospitals, and everyday consumer products, creating serious safety and security risks.

The bill essentially bans most e-waste exports, with very limited exceptions. Companies can only export old electronics if those items fall into specific categories: devices that have been tested and proven to work perfectly, electronics that have been completely destroyed so they can't be reassembled, or recalled products being returned by manufacturers. Anyone wanting to export these allowed items must register with the government, file detailed paperwork for each shipment, and provide documentation proving the receiving company can properly handle the materials. The rules don't apply to people sending five or fewer personal items overseas, and companies can still send used electronics to their own subsidiaries abroad if the items will be used for their original purpose.
