# Understanding the ESCRA Act: New Protections Against Credit Repair Scams

The credit repair industry has a serious problem with scams. Companies promise to fix your credit for a fee, take your money upfront, and then either do nothing or use tactics that don't actually work. This bill, called the Ending Scam Credit Repair Act (ESCRA), cracks down on these fraudulent practices by creating stricter rules for how credit repair companies can operate and what they're allowed to charge you.

The most important change affects how credit repair companies get paid. Right now, many of them collect fees before proving they've actually helped you. Under this new law, credit repair organizations can't take your money until they show you proof—in the form of an official credit report from at least six months after they've done their work—that they actually improved your credit. This is a huge shift because it means you won't be paying upfront for promises that may never materialize. The law also cracks down on a practice called "jamming," where companies flood credit bureaus with repeated disputes about the same items on your credit report. Going forward, they can only resubmit disputes if the credit bureau has already investigated the first one, if the bureau has sent you results, or if there's genuinely new information to add.

The bill also requires credit repair companies to be more transparent and accountable. They must now clearly disclose that they're a credit repair organization when they contact credit bureaus on your behalf, include their state license number, and respond within 15 business days if a creditor asks for clarification. Additionally, starting January 1, 2026, credit repair organizations must be licensed by their state—no more operating without any oversight. The law also strengthens protections by making it easier for consumers to report fraud to the Consumer Financial Protection Bureau and Federal Trade Commission, and it increases penalties for violations, including a minimum of $500 per violation. These changes mean that if a credit repair company breaks the rules, you'll have stronger legal grounds to sue them and recover damages.

Ending Scam Credit Repair Act or the ESCRA ActThis bill revises the Credit Repair Organizations Act and creates additional requirements for credit repair organizations (CROs).Under current law, it is illegal for a person (including a&nbsp;CRO) to make false or misleading statements regarding a consumer’s creditworthiness or standing to a consumer reporting agency or to a consumer credit provider. The bill additionally prohibits making such statements to the Consumer Financial Protection Bureau, the Federal Trade Commission, or law enforcement. To be subject to this prohibition, the bill also requires such statements to be made knowingly.The bill also revises CRO obligations to consumers. A CRO is prohibited from charging a consumer for a service (e.g., getting inaccurate information removed from a credit report) until the CRO provides proof of success not less than six months after providing the service. The bill also requires&nbsp;additional disclosures to consumers, requires the retention of any recorded telephone calls, and increases the time records must be retained from two to five years. In addition, consumers must be given copies of all communications sent on their behalf.Under the bill, all persons must be licensed by a state to act as a&nbsp;CRO. The bill also restricts a CRO’s ability to submit multiple credit disputes regarding the same information.The bill also sets a minimum liability amount for damages of $500 for each violation of the Credit Repair Organizations Act.
