# Understanding the Migratory Bird Protection Act of 2025

This bill creates a new system for handling situations where migratory birds are accidentally killed or injured during human activities. Right now, federal law prohibits killing migratory birds, period—even if it happens by accident. This bill changes that by allowing the government to issue permits that let certain industries and activities cause some bird deaths, as long as they follow specific rules and get official permission first.

The bill sets up a permit system run by the U.S. Fish and Wildlife Service where companies and organizations can apply for authorization to cause "incidental take"—meaning accidental bird deaths that happen as a side effect of their operations. For example, a wind farm, construction company, or utility might apply for a permit that allows them to accidentally kill a certain number of birds while operating. If someone causes bird deaths without a permit, they can be fined up to $10,000 per violation. If the bird deaths result from reckless or grossly negligent behavior, the penalties are much steeper. The bill also allows the government to take legal action to stop unpermitted activities.

To fund this new system, the bill lets the Fish and Wildlife Service collect fees from companies that get permits. The money goes into a special "Migratory Bird Recovery Fund" that pays for running the permit program and for conservation efforts to help bird populations affected by these activities. The bill also requires $10 million per year in government funding and mandates that the Fish and Wildlife Service conduct research to better understand how to reduce bird deaths and monitor whether the permit system is actually protecting bird populations. Every five years, the government must report to Congress on whether bird populations are staying healthy under this new system.
