# Empty Lots to Housing Act: Plain Language Summary

When the federal government funds transportation projects—like highways, bridges, or transit systems—sometimes they acquire land that ends up not being needed for that original purpose. Right now, that unused land typically gets sold off. This bill changes that by allowing the government to give that land to local governments, nonprofits, or private developers instead, as long as they promise to build affordable housing on it. The idea is to turn these empty lots into homes for people who need affordable places to live, especially in areas near public transportation.

Here's how it would work in practice: Say a city received federal money to build a new transit line and bought several parcels of land for the project, but ended up not needing all of them. Instead of selling those extra parcels to the highest bidder, the city could transfer them to a nonprofit housing organization or a developer who specializes in affordable housing. The developer wouldn't have to pay for the land, which significantly reduces the cost of building affordable apartments or homes. This is particularly valuable in expensive urban areas where land costs are a major barrier to creating affordable housing.

There are important protections built in to make sure this actually benefits lower-income families. Whoever develops the housing must keep at least 40 percent of the units affordable for families earning no more than 60 percent of the area's median income for 30 years. Within that 40 percent, at least 20 percent must go to families earning 30 percent or less of the median income. Rent for these units can't exceed 30 percent of a family's income. If a private developer is involved rather than a nonprofit or local government, the federal government has to verify they have a track record of successfully building or operating affordable housing.
