This bill is designed to lower prescription drug prices by allowing the government to strip away the special protections that drug manufacturers get when their prices are considered too high compared to what the same drugs cost in other countries. Here's what that means in practical terms.

The government would create a system to review brand-name drugs at least once a year and compare their U.S. prices to what those same drugs cost in Canada, the United Kingdom, Germany, France, and Japan. If a drug costs more in America than the median price in those five countries, it gets flagged as "excessively priced." The government can also flag drugs as overpriced based on other factors, like whether the price has jumped faster than inflation, how many patients need the drug, or whether it actually provides better health benefits than existing alternatives. Once a drug is labeled as excessively priced, the government would end the manufacturer's exclusive right to make and sell it—meaning other companies could start producing generic or similar versions immediately, which typically drives prices down significantly.

Companies that get licenses to make these cheaper versions would have to pay the original manufacturer a royalty (a percentage of sales), but the bill requires that royalty to be reasonable and set at a level that still allows the generic version to be sold at a lower price than the original. Drug manufacturers would also have to report detailed information annually about their pricing, research costs, marketing spending, and global revenues—information that would be made public in a searchable database. Companies that fail to report this information or provide false data face financial penalties based on a percentage of that drug's sales.

For patients and taxpayers, the potential benefit is significant: more competition in the drug market typically means lower prices. However, drug manufacturers argue this could discourage investment in developing new medications. The bill also includes protections against companies using unfair tactics to block competitors from entering the market once their exclusive rights are removed.
