# Understanding the Back the Blue Act of 2023

This bill creates new federal crimes and penalties specifically targeting violence against law enforcement officers, judges, and first responders. It's designed to provide stronger legal protections for people in these professions at the federal level.

The bill establishes three main new federal crimes. First, it makes it illegal to kill or attempt to kill federal judges, federal law enforcement officers, or state and local law enforcement officers who receive federal funding—either while they're working or because of their job. The punishment is severe: at least 10 years in prison, or life imprisonment, and potentially the death penalty if someone is actually killed. Second, it creates a federal crime for assaulting these same officers, with sentences ranging from 1 to 20 years depending on how serious the injury is. If a weapon is used, the minimum sentence jumps to 20 years. Third, it makes it a federal crime to flee across state lines or to another country to avoid prosecution for killing a law enforcement officer, with a mandatory 10-year sentence on top of any other punishment.

The bill also changes how federal courts handle appeals in death penalty cases involving murdered law enforcement officers. Specifically, it limits the ability of death row inmates to challenge their sentences through federal appeals if they were convicted of killing a police officer or judge. Additionally, the law allows law enforcement officers and judges to carry firearms in federal buildings and court facilities, including storing them in secure areas, and it clarifies that qualified officers can carry concealed weapons in school zones.

Finally, the bill allocates up to $20 million per year through 2028 to grant money for police departments and community organizations to improve relationships between law enforcement and the communities they serve, focusing on transparency, training, and officer wellness programs.

Back the Blue Act of 2023 This bill establishes new criminal offenses for killing, assaulting, and fleeing to avoid prosecution for killing a judge, law enforcement officer, or public safety officer. Additionally, the bill <ul> <li>expands the list of statutory aggravating factors in death penalty determinations to also include the killing or attempted killing of a law enforcement officer, judge, prosecutor, or firefighter or other first responder; </li> <li>broadens the authority of federal law enforcement officers to carry firearms; and</li> <li>limits federal court review of challenges to state court convictions for killing a public safety officer or judge.</li> </ul> Finally, it directs the Department of Justice to make grants to law enforcement agencies and nongovernmental organizations to promote trust and improve relations between law enforcement agencies and the communities they serve.
