The key word here is "non-cash"—donors wouldn't receive money they could pocket, but rather practical support to remove the financial burden of donating. These pilot programs would be limited to five years, require approval from the Department of Health and Human Services, and go through an ethical review process to make sure they're not exploitative.

The bill's supporters point to Israel as an example: when that country implemented similar incentives in 2010, organ donations roughly tripled over the next decade. The bill emphasizes that the current system hasn't been properly tested and that experts believe trials are necessary to find better ways to increase donations. For patients waiting for transplants, this could mean shorter wait times and better health outcomes. For taxpayers, the math is compelling—each kidney transplant saves Medicare about $146,000 over ten years compared to dialysis treatment, and if organ supply could meet demand, taxpayers could save over $14 billion annually. The bill essentially says: let's test whether removing financial barriers to donation actually increases the organ supply, while keeping strict safeguards in place to prevent exploitation.

Organ Donation Clarification Act of 2021 This bill specifies that certain payments and pilot programs relating to organ donation do not violate the National Organ Transplant Act, which prohibits the exchange of valuable consideration for human organs. Specifically, it excludes additional types of reimbursements and payments related to organ donation from the definition of valuable consideration, such as costs for (1) dependent care; (2) certain medical expenses for up to 10 years after a donation; (3) paperwork or legal services; and (4) term life insurance policies, subject to some limitations. In addition, the federal government, states, or local governments may carry out pilot programs to evaluate the effects of removing disincentives or providing noncash benefits on the availability of organs for transplant, provided these programs meet ethical and other conditions.
