This bill tackles the fentanyl crisis from multiple angles—prevention, treatment, law enforcement, and penalties. The core problem it addresses is straightforward: fentanyl, a synthetic opioid that's extremely potent and deadly, is being mixed into counterfeit pills and other drugs, causing a surge in overdose deaths. The bill recognizes that roughly four out of every ten fake pills seized by the DEA contain lethal doses of fentanyl, and teenagers are increasingly at risk because these pills are sold on social media and look like legitimate prescription medications.

On the prevention and treatment side, the bill pushes for public education campaigns to warn people about fentanyl dangers and counterfeit pills, particularly targeting teenagers, parents, and educators. It expands grant programs that help schools train teachers to carry and administer naloxone (also known as Narcan), the medication that can reverse an opioid overdose. The bill also directs the federal government to fund treatment programs in states and communities, recognizing that addiction is a health issue requiring medical intervention. This includes expanding access to medications like methadone and buprenorphine that help people recover from opioid addiction, as well as making fentanyl test strips more widely available so people can check whether drugs contain fentanyl before using them.

The law enforcement portion significantly increases penalties for people who sell counterfeit pills or fentanyl-laced drugs. If someone's illegal drug activity causes serious injury, they face up to 10 years in prison and $1 million in fines. If it causes death, they can face life imprisonment and up to $5 million in fines. The penalties are even harsher—up to 20 years and $5 million for serious injury, or life imprisonment and $10 million for death—if the person intentionally defrauded or misled someone about what they were selling. There's an additional 5-year sentence for anyone selling these drugs online. The bill also directs the Attorney General to increase resources for investigating and prosecuting fentanyl traffickers and to create a task force coordinating federal, state, and local law enforcement efforts.

Comprehensive Response to Fentanyl-Related Substances and Fentanyl-Laced Substances Act This bill establishes several programs and requirements to address the use of fentanyl and fentanyl-laced substances. For example, the bill expands the Comprehensive Opioid Abuse Grant Program in the Department of Justice (DOJ) to include training and resources for teachers on how to carry and administer opioid overdose reversal drugs (e.g., naloxone). DOJ must also increase resources and establish an interagency task force for law enforcement agencies to combat the trafficking of fentanyl-laced substances. Additionally, the Department of Health and Human Services must develop a national strategy to prevent the use of fentanyl-laced substances, award grants to state and localities for treatment programs for those who are addicted to fentanyl-laced substances, and research the health effects of fentanyl-laced substances. The bill also increases criminal penalties for adulterating or misbranding drugs if the violation results in serious bodily injury or death (imprisonment of up to 10 years, a fine of up to $1 million, or both for violations that result in serious bodily injury, and up to life imprisonment, a fine of up to $5 million, or both for violations that result in death). Penalties are higher for violations that include the intent to defraud or mislead. The bill adds up to 5 years of additional imprisonment if the violation involves drugs that are promoted or sold online.
