# Understanding the SAFE Act of 2023

This bill is about protecting American livestock exports when animal diseases break out. When diseases like bird flu or other animal illnesses hit the U.S., other countries often ban imports of American meat and animal products as a safety measure—even if the disease is only in one region and doesn't affect the entire country. This bill gives the U.S. Department of Agriculture the power to negotiate with other countries to prevent these blanket bans and instead work out more targeted trade rules based on where the disease actually exists.

The key idea is something called "regionalization." Instead of a foreign country saying "we won't buy any American beef because there's bird flu in Iowa," they could agree to only avoid products from the affected area while still accepting shipments from disease-free regions. The bill authorizes agriculture officials to work with the U.S. Trade Representative to make these kinds of deals with major trading partners. These negotiations should also consider the latest scientific research about animal diseases, so agreements are based on current knowledge rather than outdated fears.

The bill also requires the USDA to set up a faster notification system. If the Food Safety and Inspection Service removes any language from its import and export guidelines, state agriculture departments and livestock producer groups must be notified within three days. This keeps farmers and state officials in the loop quickly when trade rules change, so they're not caught off guard by sudden shifts in what they can or can't export.

Overall, this bill aims to help American farmers and ranchers by reducing the economic damage from animal disease outbreaks. When diseases happen, farmers already face losses—this bill tries to prevent additional losses from countries overreacting with sweeping trade bans that go beyond what's actually necessary for safety.

Safe American Food Exports Act of 2023 or the SAFE Act of 2023This bill allows the Department of Agriculture (USDA) to preemptively negotiate regional export ban agreements for known animal disease threats that apply only to areas affected by animal disease outbreaks to enable the continuation of exports from areas not affected by an outbreak. The Animal and Plant Health Inspection Service, the Food Safety and Inspection Service (FSIS), and the Foreign Agricultural Service, in consultation with the Office of the U.S. Trade Representative, are authorized to negotiate the regionalization, zoning, compartmentalization, and other trade agreements regarding outbreaks of known animal disease threats of trade significance&nbsp;with countries with export markets for livestock animals or animal products from the United States.In addition, USDA must promulgate a regulation requiring that, within three days of removing any language from the FSIS Import and Export Library, FSIS notify each state department of agriculture, each lead state&nbsp;agency for animal disease, and any state and national producer organizations representing impacted livestock producers. (The FSIS library provides country and product specific information for (1) meat and poultry exports, and (2) products eligible for import to the United States.)&nbsp;
