# Emergency Spending Accountability Act: What It Actually Does

When Congress declares something an emergency and spends extra money on it, this bill says they have to make cuts elsewhere to pay for it. Specifically, if Congress passes emergency spending in any given year, the Office of Management and Budget would be required to automatically cut other government programs over the next five years. The cuts would happen in equal amounts each year, with each year's reduction being one-fifth of the total emergency spending amount. So if Congress approved $100 billion in emergency spending, the government would have to cut $20 billion from other programs each of the following five years.

The cuts would apply differently depending on the type of spending. If the emergency money is for regular government operations and programs, the cuts come from those same types of programs. If it's for mandatory spending like welfare programs, the cuts come from mandatory spending. However, some programs are completely protected from these cuts: Social Security, Medicare, Veterans Affairs benefits, and the entire Defense Department budget cannot be touched. This means the cuts would fall on everything else—education, infrastructure, environmental programs, scientific research, and other federal agencies.

The bill also requires Congress to justify why emergency spending is truly necessary. Whenever a bill containing emergency spending is considered, lawmakers must publish a detailed explanation in the Congressional Record explaining why each instance of emergency spending meets the legal definition of being both unexpected and truly urgent. This is meant to prevent Congress from labeling routine spending as "emergency" just to avoid budget limits.

The practical effect would be significant: it makes emergency spending much more politically difficult because Congress would know that approving emergency funds automatically triggers cuts to other programs down the line. Supporters argue this encourages fiscal responsibility, while critics worry it could prevent rapid response to genuine crises or force cuts to important programs that have nothing to do with the emergency.
