This bill would prevent doctors, hospitals, and other healthcare providers that accept Medicare, Medicaid, or CHIP insurance from asking patients under 18 years old about their gender identity or sexual orientation on intake forms or during data collection—unless that information is directly necessary to diagnose, treat, or prevent the specific health condition the young person is seeking care for.

In practical terms, when a teenager goes to a doctor's appointment, the healthcare provider couldn't ask questions like "What is your gender identity?" or "What is your sexual orientation?" on the paperwork they fill out at check-in. The only exception would be if knowing this information is medically essential for treating the particular problem they came in for. For example, a doctor treating a broken arm wouldn't be allowed to ask these questions, but a doctor providing gender-affirming care could ask, since it would be directly relevant to the treatment being provided.

The bill also requires the Department of Health and Human Services to set up a system where people can report healthcare providers who violate this rule. Providers who break this law could face penalties, including being banned from participating in Medicare and state health insurance programs. The restrictions would take effect 180 days after the bill becomes law, giving healthcare providers time to update their intake forms and procedures.
