The Break the Chain Act would dramatically reshape how family immigration works in the United States by eliminating most family-based immigration categories and replacing them with a much more restrictive system. Right now, U.S. citizens and permanent residents can sponsor various family members to immigrate—including parents, siblings, adult children, and cousins. This bill would essentially shut down most of those pathways.

The bill's most significant change is removing parents from the "immediate relative" category, which currently allows U.S. citizens to sponsor their parents without numerical limits. Under this bill, only spouses and minor children of U.S. citizens would qualify as immediate relatives. Adult children, siblings, grandparents, and parents of adult citizens would no longer have a direct immigration route. The bill would also eliminate several family preference categories that currently allow permanent residents to sponsor their spouses and children, and U.S. citizens to sponsor their adult children and siblings. Instead, it creates a new temporary visa category for parents of adult U.S. citizens—but with major restrictions. These parents could only stay for five-year periods, couldn't work, couldn't receive government benefits, and would need their adult child to provide health insurance at no cost to them.

For people with family members abroad, this bill would essentially close the door on most family reunification. If you're a U.S. citizen wanting to bring over your parents, siblings, or adult children, or if you're a permanent resident wanting to sponsor your spouse or children, those petitions would no longer be accepted. The bill also includes a "aging out" provision that could affect young people in the immigration process—if they turn 25 or get married before a visa becomes available, they would lose eligibility, even if they were younger when their petition was filed. The practical effect would be one of the most restrictive family immigration policies in modern U.S. history, fundamentally changing how American families can reunite across borders.

Break the Chain Act This bill makes various changes related to family-sponsored immigration, such as narrowing the definition of what constitutes an immediate relative and lowering the annual numerical cap on certain classes of family-sponsored visas. The alien parents of U.S. citizens shall not qualify for visas for immediate relatives, which are not subject to any direct numerical limits. Currently, the spouses, unmarried children under 21, and parents of citizens are considered immediate relatives. The bill also reduces the baseline annual cap for family-sponsored visas from 480,000 to 87,934, and revises the methods for calculating the cap. Currently, the 480,000 cap may be adjusted depending on various factors but shall not be less than 226,000. A spouse or child of a sponsoring alien lawfully admitted for permanent residence shall be subject to the family-sponsored visa cap. The bill revises the rules for determining whether an alien is a child for the purposes of family-sponsored immigration, and establishes that an alien who is married or turns 25 years old prior to a visa becoming available for issuance shall not qualify as a child. The bill creates a nonimmigrant classification for alien parents of adult U.S. citizens, which authorizes such alien parents for admission into the United States for an initial five-year period. Such alien parents shall not be authorized for employment or to receive any public benefits.
