# The TERMS Act: What You Need to Know About Online Account Terminations

The TERMS Act is about transparency and fairness when websites, apps, and online services kick people off their platforms. Right now, companies can ban users from their services with little explanation and no warning. This bill would change that by requiring these companies to be upfront about their rules and give people a heads-up before shutting down their accounts.

Here's what would actually happen under this law. First, every major online platform—think social media sites, email services, streaming apps, or any website where you create an account—would have to publicly post clear, easy-to-understand rules about what behavior can get you banned. They'd need to explain exactly what's prohibited, how they enforce the rules, whether you can appeal if they ban you, and whether they'll punish you for things you do outside their platform (like posts on other social media). Right now, many companies bury these policies in dense legal documents or change them without telling anyone, so this would be a real shift toward clarity.

Second, before terminating or suspending your account, companies would have to give you written notice at least seven days in advance, telling you specifically what you did wrong and how it violated their rules. There are exceptions—if a court orders them to shut you down or if there's an immediate safety threat, they can act faster. But for most situations, you'd get advance warning and a chance to know what's happening. If you want, you could ask the company to publicly post the notice so others know why you were banned.

Third, every year these companies would have to publish detailed reports showing how many people they banned, what rules were violated, who reported the violations, and how many people successfully appealed their bans. This data would be available in formats anyone can read and analyze, creating public accountability for how these companies actually enforce their policies.

The Federal Trade Commission would enforce this law, treating violations as deceptive business practices. Companies that don't comply could face penalties. The FTC would also issue guidance to help companies understand what compliance looks like, though that guidance wouldn't be legally binding—companies just need to follow the actual law.
