The second restriction removes clauses that prevent class action lawsuits. A class action is when many people with the same problem sue together as a group—for example, if an insurance company wrongly denied coverage to thousands of patients for the same reason. These lawsuits are powerful because they give regular people the strength to challenge big companies. Insurance companies often include language saying "you can't join a class action," which means each person has to sue alone. This bill prohibits that restriction, allowing patients to band together in court. The bill applies to all health insurance plans, whether they're employer-sponsored, individual plans, or government programs, and it makes clear that courts—not arbitrators—will decide whether these new protections apply in any given case.

Justice for Patients Act This bill prohibits private health insurance plans from (1) including any mandatory arbitration provision for disputes related to the plan, or (2) limiting the ability of a plan enrollee to participate in a class action lawsuit related to the plan. Further, the applicability of this bill to an arbitration agreement may not be determined by an arbitrator.
