# Water and Agriculture Tax Reform Act of 2023

This bill makes changes to how the federal government taxes water companies that operate irrigation systems, particularly those organized as mutual ditch or irrigation companies. These are cooperative organizations where farmers and landowners pool resources to manage shared water delivery systems, which are common in western states where water management is critical for agriculture.

Currently, these water companies face tax restrictions because they're classified as tax-exempt organizations. The problem is that when they earn money from leasing water, selling water rights, or transferring water to other users, the tax code treats this income in ways that can discourage these transactions. This bill removes those tax barriers by allowing water companies to earn income from water leasing and transfers without losing their tax-exempt status, as long as they use that money for operations, maintenance, capital improvements, or to deliver water outside their existing system.

The bill also addresses how these companies handle voting rights. It clarifies that water companies can allow voting power based on how many shares a member owns, rather than requiring one-vote-per-member regardless of share size. This makes sense for organizations where different members contribute different amounts of water or resources.

The practical effect is that this bill makes it easier and more financially attractive for water companies to lease or trade water rights, which supporters argue promotes water conservation and efficiency. By removing tax penalties for these transactions, farmers and communities in water-stressed regions would have more flexibility to move water to where it's needed most, whether that's to other farms, municipalities, or conservation efforts. The changes take effect for tax years beginning after the bill becomes law.
