Right now, when regulators invoke these "systemic risk" powers to save a failing bank, there's limited public accountability for the decision. This bill changes that by requiring two independent investigations every time this happens. First, the Government Accountability Office (the federal government's independent watchdog) must review the decision within 60 days and again after 180 days. Second, the bank's primary federal regulator must submit its own detailed report on the same timeline. These reports would go directly to Congress and would have to explain the reasoning behind the decision, what problems at the bank led to its failure, whether bank executives mismanaged it, and whether regulators themselves dropped the ball in overseeing the institution.

The reports would also need to examine compensation practices at the failed bank and look at whether other factors—like credit rating agencies, investment banks, or the Federal Reserve's lending decisions—contributed to the collapse. Importantly, the bill requires regulators to disclose confidential supervisory information that's normally kept secret, so Congress can see what regulators knew and when they knew it. The goal is straightforward: when taxpayer money or special government powers are used to rescue a bank, there should be transparent, documented explanations of why that decision was made and what went wrong in the first place.

Systemic Risk Authority Transparency Act This bill requires banking regulators to submit a report to Congress in the event of the failure of an insured depository institution that leads to a systemic risk determination by the Department of the Treasury. Regulators must report confidential supervisory information relating to the institution, any institutional mismanagement by the executives and the board, any shortcomings by the regulator, and recommendations to improve the safety and soundness of similarly situated institutions. This report must be made no later than 60 days after such a determination and again 180 days afterwards. The Governmental Accountability Office (GAO) must report on additional factors in its report regarding such a determination. Specifically, GAO must report on any mismanagement by the executives and board of the institution, a review of the institution's compensation practices, supervisory or regulatory shortcomings, actions taken by regulators, and other relevant information. The bill also requires this report to be made no later than 60 days after such a determination and again 180 days afterwards.
