# Understanding the Countering Wrongful Detention Act of 2025

This bill creates a new tool for the U.S. government to pressure foreign countries that are holding American citizens as prisoners without legitimate legal reasons. When a country wrongfully detains an American—whether to use them as a bargaining chip in negotiations or for political reasons—the Secretary of State can now officially label that country as a "State Sponsor of Unlawful or Wrongful Detention." The bill sets clear triggers for when this label can be applied. A country gets designated if Americans are being wrongfully detained there, if the government refuses to release detained Americans within 30 days of being notified about them, or if the government appears to be supporting or enabling these detentions. Once designated, the label automatically expires after six months unless Congress votes to approve keeping it in place. This means Congress gets a say in whether the designation continues, preventing the executive branch from acting alone indefinitely.

Once a country receives this designation, the government must figure out what consequences to impose. The bill tells officials to consider existing tools like economic sanctions, visa bans for officials from that country, restrictions on military aid or weapons sales, and freezing assets. The bill specifically mentions nine countries that Congress wants evaluated for this designation: Afghanistan, Eritrea, Iran, Nicaragua, Russia, Syria, Venezuela, Belarus, and China. The State Department must also brief Congress regularly on these countries and what steps are being taken to protect Americans abroad and secure the release of those detained.
