This bill prevents the federal government from punishing homeless people for basic survival activities on federal public lands. Right now, people experiencing homelessness can be arrested or fined for things like sleeping, eating, sitting, or storing their belongings on federal property—even when they have nowhere else to go. This bill says that can't happen anymore. Instead of treating homelessness as a crime, the law focuses on whether safe, accessible shelter is actually available to the person.

The bill protects specific activities that homeless individuals need to survive. People can rest, sleep, eat, drink, and protect themselves from weather on federal lands. They can move around freely in public spaces, ask for or accept donations of food and money, keep their possessions private (like items in a tent or vehicle), practice their religion, and live in a parked car or RV. If someone is living in a vehicle, they get time to move it before it's towed and can retrieve it for free or at a reduced cost based on what they can afford. The one exception is if the government provides genuinely adequate alternative shelter—meaning a safe indoor space that's free, available permanently without daily reapplication, allows people to bring pets and family members, and accommodates disabilities.

The bill also creates legal protections for people charged with crimes related to survival activities. If someone is arrested for sleeping outside or other survival-related offenses, they can argue in court that they had no safe place to go instead. The law assumes this is true unless the government proves otherwise. If the government violates these protections, the Attorney General or the person harmed can sue in federal court, and if they win, the government has to pay their legal fees. This applies only to federal lands and federal agencies, not state or local governments, though the bill suggests it shouldn't prevent people from using other legal protections they might have under constitutional law.
