# Understanding the Disaster Reforestation Act

This bill helps timber owners get better tax breaks when disasters destroy their forests. Normally, when you lose property to a disaster like a fire or storm, you can deduct the loss on your taxes, but the deduction is limited to how much the property has decreased in value. This bill changes that rule specifically for uncut timber (trees still growing in the forest) by letting owners deduct the full difference between what the timber was worth before the disaster and what salvage value remains—essentially allowing them to deduct the complete loss of the destroyed trees rather than just the decrease in property value.

To qualify for this better tax break, timber owners have to meet several requirements. They must get a professional appraisal done within a year of the disaster to determine what the timber was worth before and after the loss. The appraisal has to follow official professional standards and be completed by a certified appraiser. Additionally, the timber must be part of an active timber business (not just a passive investment), and the owner must actually replant the land within five years of the disaster. This reforestation requirement is key—the bill essentially rewards forest owners who commit to rebuilding their forests after disasters strike.

The practical effect is that timber companies and forest owners who experience losses from fires, storms, insects, disease, drought, or theft will have a stronger financial incentive to replant their forests, since they'll get a more substantial tax deduction to help offset their losses. This applies to both mature timber ready for harvest and younger, pre-merchantable trees still growing. The bill takes effect for tax years beginning after it's signed into law.

Disaster Reforestation Act This bill sets forth a special rule for the tax deduction for casualty losses of uncut timber (including pre-merchantable timber). It provides that in losses of any uncut timber from fire, storm, insects, invasive species, drought, or other casualty, or from theft, the basis for determining the amount of the deduction for such loss shall not be less than the excess of the value of such timber determined immediately before such loss was sustained, over the salvage value of such timber. To be eligible for the casualty loss deduction, the uncut timber subject to the loss must be reforested not later than the close of the five-year period beginning on the date of the loss.
