This bill stops that from happening and forces courts to actually hear these cases on their merits.

Here's what changed: Previously, courts could dismiss Nazi art theft cases using defenses like "laches" (a legal term meaning you waited too long to sue), adverse possession, or other time-based arguments. The bill explicitly bans these defenses for Holocaust art recovery cases. It also blocks courts from dismissing cases using other procedural excuses like "act of state doctrine" or "forum non-conveniens"—basically legal reasons to say "this isn't the right place to sue" or "we shouldn't get involved." The bill makes clear that these technical arguments can't be used to avoid hearing the actual facts of whether someone's art was stolen.

The bill also expands who can bring these cases. It removes a rule that previously prevented people from suing if their government (not the U.S.) took their property, meaning victims of any nationality can now pursue claims. Additionally, it makes it easier to serve legal papers on defendants anywhere in the United States, rather than only in specific locations. The changes apply to cases already in court as well as new cases filed after the bill passes, giving people currently fighting these battles a second chance if their cases were previously dismissed on these technical grounds.
