In other words, if a bank or financial company doesn't follow the guidance exactly, that alone doesn't prove they broke the law. They would still need to follow actual laws and regulations, but the guidance itself isn't enforceable.

The requirement kicks in for any new guidance issued after the bill becomes law. It doesn't apply to formal rules that go through the official rulemaking process, internal agency memos, or legal opinions. Supporters argue this makes it clearer what financial companies must do versus what's merely suggested, while critics might worry it could weaken agency oversight by making guidance less authoritative.
