This bill would allow small cannabis growers and manufacturers to ship their products directly to customers across state lines using the mail and commercial carriers like FedEx or UPS. Right now, federal law prohibits mailing cannabis, even in states where it's legal. This bill changes that for small operations—specifically, growers with one acre or less of outdoor plants (or equivalent space in greenhouses or indoor facilities) and manufacturers earning less than $5 million annually.

The key catch is that this only works in states where cannabis is already legal, and only to customers in states where it's also legal. So a small grower in Colorado could mail products to a customer in California, but not to someone in a state where cannabis remains illegal. The bill requires age verification—anyone receiving a shipment must be at least 21 years old, verified through government ID or an online age-checking service.

The bill also clarifies that states can't ban cannabis shipments if they've already legalized it, but states that completely prohibit cannabis can still block it from passing through their borders. Importantly, this entire law only takes effect once cannabis is removed from the federal government's list of controlled substances and federal criminal penalties for cannabis possession are eliminated. Until that happens, the current federal ban on mailing cannabis remains in effect.
