This bill creates a new tax credit to help people afford infertility treatments. If you pay for fertility treatments, you can claim a credit worth 50% of what you spent on those costs when you file your taxes. For example, if you spent $10,000 on infertility treatment, you could get a $5,000 credit on your taxes.

The credit has some limits based on your income. If you earn more than a certain threshold (which adjusts yearly for inflation), the credit starts to reduce. The maximum credit you can claim in any single year is capped at the same dollar limit used for adoption credits, which is currently around $15,000. However, up to $5,000 of your credit can be refundable, meaning you could get money back even if you don't owe taxes. If you have leftover credit you can't use in one year, you can carry it forward to use in the next five years.

The credit covers treatments provided by licensed doctors and includes fertility preservation procedures—like egg or sperm freezing—done before cancer treatment or other medical procedures that might cause infertility. You can't claim the credit for expenses that insurance already paid for or that you received government grants to cover. Married couples must file joint tax returns to claim this credit. The credit becomes available starting with the 2025 tax year.
