This bill requires health insurance plans to cover fertility treatments if they already cover pregnancy and childbirth services. The coverage would include a wide range of fertility-related care: egg and sperm freezing, artificial insemination, in vitro fertilization (IVF), genetic testing of embryos, fertility medications, and egg or sperm donation. The key requirement is that a doctor determines the treatment is medically appropriate—people wouldn't need to be formally diagnosed with infertility to qualify, and the treatment just needs to happen at a facility that meets federal standards.

The bill applies to most health insurance plans, including employer-sponsored insurance and individual plans purchased on the marketplace. Insurance companies can't charge higher copays, deductibles, or coinsurance for fertility treatments than they do for other medical services. They also can't offer people incentives to skip fertility treatment, prevent doctors from discussing these options with patients, or penalize doctors for providing fertility care. Insurance companies must notify everyone covered by their plans about this fertility coverage by January 1, 2027, and annually after that.

The bill includes important protections against discrimination—insurance companies can't exclude people from coverage based on race, sex, age, disability, or other protected characteristics. However, the bill doesn't require anyone to undergo fertility treatment; it simply ensures that if someone wants it and their doctor recommends it, their insurance should cover it the same way it covers other medical services. Insurance companies can still negotiate what they pay providers for these services, so costs to the insurance system could vary.
