# What the RESTART SUNSET Act Actually Does

This bill changes how federal agencies review their own rules and regulations. Right now, agencies are supposed to periodically look at their existing rules to see if they still make sense, but the process is pretty loose and there's not much enforcement if they don't do it. This bill tightens things up by requiring agencies to actually review all their rules within a ten-year window and publish a yearly list showing which rules don't significantly impact small businesses.

The key change is what happens if an agency gets caught not doing these reviews properly. Currently, if a court finds that an agency failed to review its rules as required, the court can order the agency to fix the problem. Under this bill, if a court determines an agency didn't follow the review requirements, the court must immediately stop the agency from enforcing that rule. This is a much stronger consequence than what exists today. In practical terms, this means rules that haven't been properly reviewed could potentially be blocked from being enforced, which could affect everything from environmental regulations to workplace safety standards to consumer protections, depending on which rules haven't been reviewed.

The bill also adds a new requirement for agencies to publicly list which rules they've determined don't have a significant economic impact on small businesses. This is meant to increase transparency, though it's worth noting that what counts as "significant" impact is still somewhat subjective. For small business owners, this could mean more visibility into which regulations might apply to them, but it could also create opportunities for legal challenges to rules that haven't been recently reviewed or that agencies haven't formally evaluated for small business impact.
