Once a company applies for federal approval, the Commission would have to issue a certificate allowing construction if the project meets certain criteria: the company is capable of building it, the project will help with renewable energy, reduce congestion, or improve grid reliability, and the company tries to use existing power line routes rather than cutting new paths through land.

The bill does require the federal government to notify and get input from affected landowners, Native American tribes, state agencies, and the public before approving a project. Landowners would receive written notice explaining that transmission lines and towers could be built on their property, and they'd have a chance to comment. However, if the federal government approves the project, it could use eminent domain to take private land for the transmission lines—though the bill says companies should minimize this "to the extent practicable." The process includes environmental reviews and a 90-day public comment period, but ultimately, federal approval would override state and local decisions about whether these projects should be built.
