This bill addresses a significant gap in retirement protections for married people, particularly women who tend to have lower retirement savings than men. Currently, old-style pension plans (called defined benefit plans) require a spouse's permission before someone can withdraw their retirement money, but newer 401(k)-style plans (called defined contribution plans) have no such requirement. This bill changes that by requiring spouses to consent before large retirement withdrawals or major changes to who gets the money after death.

The bill recognizes that women face serious retirement challenges: they earn less over their lifetimes due to wage gaps and caregiving responsibilities, they're more likely to work part-time jobs without retirement benefits, and they end up with significantly lower retirement income than men. When couples divorce, retirement savings are often the biggest asset to divide, and women need protection to ensure they don't lose their share. The new spousal consent requirement would work similarly to what federal employees already have—a spouse must agree in writing before someone can take a large lump sum from their retirement account, though there are exceptions for things like required minimum withdrawals and annuities that provide lifetime income to both spouses.

Beyond the consent requirement, the bill funds two major initiatives: $100 million annually for financial literacy programs teaching women about retirement planning, and another $100 million annually to help low-income women and domestic violence survivors navigate divorce proceedings to actually claim the retirement benefits they're entitled to receive. The bill also requires financial companies selling retirement products to provide easy access to consumer education resources from the government.
