# What the Strengthening Our Workforce Act of 2025 Actually Does

This bill creates a new temporary legal status for certain immigrants already living and working in the United States. Specifically, it allows undocumented immigrants, DACA recipients (people who came to the country as children), and some visa holders to get a two-year "conditional" legal status that comes with permission to work. The key requirement is that these people must have been in the U.S. since January 1, 2024, and must work in one of many designated "essential" jobs—ranging from healthcare and education to construction, agriculture, food service, childcare, and manufacturing.

To qualify, applicants need to have already worked at least 100 days in one of these covered professions and must continue working at least 100 days per year in these fields during their two-year conditional period. They also have to stay physically present in the U.S. the whole time and pass a background check. The bill excludes people with serious criminal records—anyone convicted of a felony is automatically ineligible, as is anyone with three or more misdemeanors (though there are some exceptions for cannabis-related offenses and cases involving domestic violence victims). The Secretary of Homeland Security has some flexibility to waive certain grounds for rejection if it serves humanitarian purposes or family unity.

After the two-year conditional period ends, immigrants who meet all the requirements automatically get converted to permanent resident status (a green card), unless they specifically object in writing. This means they could eventually become eligible for citizenship. Importantly, these new permanent residents won't count against the annual immigration caps that normally limit how many people can become permanent residents each year. The bill essentially offers a pathway for essential workers—many of whom are already contributing to the economy—to gain legal status and stability, provided they maintain employment in critical sectors and stay out of serious legal trouble.
