# Understanding the Temporary Family Visitation Act

This bill creates a new type of short-term visa that allows foreign relatives of U.S. citizens and permanent residents to visit the United States for family reasons. Right now, if your foreign relative wants to visit you, they typically need to get a tourist visa and claim they're coming for pleasure or business. This bill adds "family purposes" as an official reason for a visit, making it clearer what the visit is actually about. The relatives who could qualify include spouses, children, parents, grandparents, siblings, aunts, uncles, nieces, and nephews of Americans or green card holders.

The key catch is that these family visits would be strictly temporary and limited. Anyone using this visa could stay in the United States for no more than 90 days per calendar year. Before they can enter, they'd need to have health insurance that covers international medical expenses for their stay, and someone in the U.S. (usually the American relative) would need to sign a legal document promising financial responsibility if the visitor needs government assistance. The visitor would also need to declare upfront that they plan to leave when their time is up. Importantly, people on this visa cannot change their status to become permanent residents while in the country—it's strictly a temporary visit.

The bill also includes safeguards against abuse. If someone previously brought a relative over on this visa and that relative overstayed their allowed time, they generally can't sponsor another relative for the same type of visa unless they can explain that the overstay was due to extraordinary circumstances beyond the person's control. This is meant to discourage people from helping relatives illegally extend their stays. Additionally, the bill allows people who are already approved to immigrate permanently but are waiting for their visa to become available to visit family in the meantime using this temporary visa, which could help families stay connected during what can be a long waiting period.
