States can still enforce laws that actually help AI development, apply the same rules to AI systems as they do to other comparable technologies, impose criminal penalties for violations, and set their own requirements when they're buying AI systems for government use. The bill emphasizes that it's not giving federal agencies new power to regulate AI design or performance—it's mainly about preventing a confusing mix of state regulations while the federal government figures out a national approach.

In practical terms, this affects AI companies, small businesses using AI tools, and states that have already passed or are considering their own AI regulations. Companies would have more certainty about which rules apply nationwide, but states lose the ability to set stricter AI standards than the federal government for the next five years.
